Welcome to JAST Fitness Inc. By accessing or using our services, including our website and mobile application, you agree to the terms and conditions set forth in this document. These terms are designed to ensure transparency, protect your rights, and clarify the obligations between you as a user and JAST. These terms comply with international privacy laws, including but not limited to the General Data Protection Regulation (GDPR) for European Union users, the California Consumer Privacy Act (CCPA) for U.S. users, and the Personal Information Protection and Electronic Documents Act (PIPEDA) for Canadian users.

  • Services: Any fitness, nutrition, or corrective exercise programs and related content provided by JAST.
  • Personal Data: Any information that can identify a user, including name, email, location, health data, etc.
  • Platform: The JAST website and mobile application, as well as any other services directly related to JAST’s offerings.
2. Account Registration and User Responsibilities
  • Account Creation: To access certain features, users must create an account by providing accurate and current personal data, including name, contact information, and health-related data.
  • Account Security: Users are responsible for maintaining the confidentiality of their login credentials. If unauthorized access occurs due to user negligence, JAST cannot be held liable.
  • Account Termination: Users may request account deletion, which will be completed within 60 days. After that period, all data will be permanently deleted. Users are encouraged to download any necessary information before submitting a deletion request.
  • Eligibility: You must be at least 16 years old to create an account. If you are between 13 and 16 years old, you must provide verified parental consent to use our services.
3. Use of the Services
  • Personal Use Only: JAST’s services are intended for personal use only and are not to be used for commercial purposes without express written permission from JAST.
  • Prohibited Activities: Users agree not to:
    • Violate any applicable law, including data protection and privacy laws (GDPR, CCPA, PIPEDA).
    • Use the platform to distribute malicious software, spam, or offensive material.
    • Reverse-engineer or copy any aspect of the platform without authorization.
    • Share account details with third parties.
  • Compliance with Local Laws: Users are responsible for ensuring that their use of the platform complies with all applicable laws and regulations in their jurisdiction.
4. Refund Policy
  • No Refunds: Once a service or plan is purchased through the JAST platform, no refunds will be issued. This includes fitness programs, nutrition plans, or corrective services. However, users may contact support to modify certain aspects of their plan, such as switching trainers or updating program details.
5. Data Collection and Privacy
  • 1. Data Collection: By using JAST, users consent to the collection and use of their personal and health-related data. We collect data such as:
    • Name, contact details, date of birth
    • Fitness data (weight, height, body composition)
    • Health-related data (injuries, allergies, medical history)
    • Usage data through cookies and tracking technologies
  • 2. Legal Basis for Processing: Personal data is processed based on user consent, contractual necessity, or legal obligations, in accordance with:
    • GDPR (Article 6) for EU users
    • CCPA for California residents
    • PIPEDA for Canadian users
  • 3. Data Sharing: We may share data with trusted service providers (e.g., cloud storage, payment processors) for the purpose of delivering the service. JAST will never sell personal data to third parties without explicit user consent.
  • 4. International Transfers: JAST may transfer personal data to countries outside of your jurisdiction, including the U.S. and Canada. 8. Limitations of Liability
  • 1. General: JAST provides its services on an "as is" and "as available" basis. While we strive to offer a secure and reliable platform, we cannot guarantee that services will be uninterrupted, error-free, or free from malware.
  • 2. Indirect Damages: JAST will not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use our services.
  • 3. Total Liability: In any event, JAST’s total liability for any claims arising from or related to the platform will not exceed the amount you paid for the services.
9. Termination of Services
  • 1. Termination by User: Users may terminate their account at any time by contacting support. Upon termination, all data associated with the user will be deleted within 60 days.
  • 2. Termination by JAST: JAST reserves the right to terminate user access to services for breach of these terms, without prior notice.
10. Changes to the Terms & Conditions
  • Modification of Terms: JAST reserves the right to modify these terms at any time. If changes are made, users will be notified via email or in-app notifications at least 30 days before the changes take effect. Continued use of the platform after the effective date of any changes constitutes acceptance of the revised terms.
11. Governing Law and Dispute Resolution
  • 1. Governing Law: These terms are governed by the laws of Canada and the United States, depending on the user’s location. For EU users, the GDPR and relevant member state laws apply.
  • 2. Dispute Resolution: In the event of any dispute, the parties agree to first attempt mediation. If mediation fails, disputes will be settled by binding arbitration under the rules of the jurisdiction in which JAST is incorporated.
